Are there laws in Virginia that penalize drivers for tailgating? You may
be already aware that tailgating has the potential to cause dangerous
accidents. One study reported by the Virginia Highway Safety Office reported
that more than 65, 000 people were injured due to tailgating in our state,
with over 121, 000 crashes that occurred from
Tailgating happens when one car is following too closely to the car in
front. If the car in front brakes suddenly or has to stop because of an
object on the road or some other distraction, the driver who is tailgating
may or may not have enough time to react to the situation. This is what
can cause a serious accident to occur.
Is Tailgating Illegal?
In Virginia, tailgating is against the law. If a driver is tailgating someone,
even if there no accident resulted, they can still face numerous penalties
that receiving a traffic ticket, and even jail time and fines. Tailgating
can occur purely by accident, as well, such as when a driver does not
realize he or she has not placed enough distance between themselves and
the car in front.
This is the recommended following distance drivers should maintain:
- If traveling less than 35 mph, stay behind at least 2 seconds
- If traveling 36 to 45 mph, stay behind at least 3 seconds
- If traveling 46 to 70 mph, stay behind at least 4 seconds
One of the ways you can count the seconds is to observe an object—a
power line, sign, or the overpass and count down from the time the vehicle
in front passes to the time that you pass. If you are the car in front,
however, this becomes trickier, as you cannot always anticipate the actions
of the vehicle following you.
