ABC 13 News Now, last week marked the beginning of the civil trial against Virginia Wesleyan
College, where a former student has filed a claim for mishandling of a
reported rape on campus.
Former Virginia Wesleyan College student “Jane Doe” and her
Jonathan Halperin, allege that the college is partly responsible for the rape that occurred in 2012.
Attorney Halperin’s opening arguments described a graphic scene.
His client claims she was invited to a party by her peer advisor, a student
and employee of the college that also works to help incoming freshman
adjust to college life. While at the party Doe details she took a shot
of alcohol, when she started to feel drugged. Doe alleges the former upperclassman
and lacrosse player, brought her back to his dorm room where he raped
her repeatedly for five hours. Attorney Halperin claims the college negligently
hired the peer advisor who was knowingly providing alcohol to underage
Jane Doe reported the case five weeks later, but the school failed to notify
the police of what happened. Attorney Halperin, says the school knew about
similar sexual assaults that took place dating back to 2009 using date
rape drugs, but the college had done nothing to help prevent future assaults
The defense claims both the victim and the attacker were drunk. Robert
Roe, the alleged rapist, argues the event was simply a consensual drunken
one night stand. But Attorney Halperin and his client argue differently,
claiming Doe sought mental health counseling and eventually had to drop
out of school due to a post-traumatic stress disorder which developed
after the sexual assault. The Norfolk school is a small college and Ms.
Doe was forced to see her alleged rapist often, which caused her to have
anxiety attacks that eventually led to her leaving college.
Many victims of sexual assault do not press charges due to the nature of
the court proceedings forcing them to face their attacker.
The civil trial is slated to last until next week.
